Terms of Sale

Preamble

These Terms of Sale are intended to apply exclusively between Hessyo (hereinafter referred to as "the COMPANY"), owner of the https://ecom-escape.com website, a self-employed business domiciled at Rue La Boétie, 75008 Paris.

and

any natural person of legal age, capable of contracting, visiting or making a purchase via the https://ecom-escape.com site, hereinafter referred to as "the CUSTOMER".

Glossary :

"TOS" refers to the Terms of Sale.

"The COMPANY" refers to Hessyo.

"The CUSTOMER" refers to any person with the above characteristics who makes a purchase on at least one of the COMPANY's sites.

"The PRODUCT", "the SERVICE", "the PROVISION" designate the elements that may be purchased or subscribed to by the CUSTOMER via the website https://ecom-escape.fr of the COMPANY.

Article 1: Purpose of the contract

The purpose of these Terms of Sale (TOS) is to govern all the rights and obligations of the parties in the context of any transaction concluded on the https://ecom-escape.fr website.

These GSC constitute the entirety of the rights and obligations of the parties in the context of their contractual relationship.

Consequently, no specific condition, at the CLIENT's initiative, may be added to and/or replace these GTC.

Any use of and/or subscription to any PRODUCT and/or SERVICE on one of the COMPANY's sites implies full, unreserved and unconditional acceptance of the present GTCS and any special conditions attached to each PRODUCT and SERVICE (offered on the https://ecom-escape.com site) by the CLIENT, who acknowledges full knowledge thereof.

Furthermore, the CUSTOMER acknowledges that he/she is informed by the present GTCS that he/she is responsible for the use of the COMPANY's sites and/or for the creation and final validation of his/her on-line order.

The COMPANY reserves the right to modify these GCS at any time and without prior notice.

Nevertheless, the applicable GTCS are those in force on the day of final validation of the order.

The fact that https://ecom-escape.com does not immediately take advantage of a breach by the CLIENT of one of its obligations contained in these GTC shall not be interpreted as a firm and definitive waiver of the obligation in question for the future.

Article 2: General conditions of participation and/or subscription to services

The PROVISIONS and SERVICES offered on the https://ecom-escape.com website are provided for information and entertainment purposes, and are not to be considered as the work of a health professional.

The CLIENT is solely responsible for the use he/she makes of the SERVICES offered on the https://ecom-escape.com website.

The COMPANY, its managers and/or partners, its employees and/or any other person involved in any of the SERVICES offered on the https://ecom-escape.com website may not be held liable for any consequences whatsoever of any use, misuse, inappropriate and/or illegal application of these SERVICES by the CLIENT, in any manner whatsoever.

Article 3: Non-competition

By making purchases on the https://ecom-escape.com website, the CUSTOMER declares that he/she is not engaged in any professional coaching activity in the same fields as those covered by THE COMPANY (relationships, dating, personal and professional effectiveness... non-exhaustive list).

The reproduction, in any way whatsoever and for any purpose whatsoever, of the information, techniques, know-how and methods offered by the https://ecom-escape.com website is strictly forbidden without the prior authorization of THE COMPANY.

Article 4: How to place an order

Orders are placed on the https://ecom-escape.com website via an online sales form.

Payment of the order is made via a secure STRIPE online payment platform, and therefore requires the CLIENT to have a valid electronic mailbox for sending and receiving.

Otherwise, the CLIENT will not be able to receive written confirmation of his/her order.

Contractual information will be presented in French.

The procedure for placing orders on the https://ecom-escape.com website comprises the following stages:

- The CLIENT selects the PRODUCT he/she wishes to order and fills in the online order form, including his/her e-mail address, which is essential for delivery of the PRODUCT ordered.

- In accordance with the provisions of articles 1316-1 et seq. of the French Civil Code, any order form signed by the consumer via the "double click" procedure constitutes an irrevocable acceptance which may only be challenged in the cases provided for in the present GTCS.

- The "double click" associated with the ordering procedure described above constitutes an electronic signature. This electronic signature has the same value as a handwritten signature between the parties, in application of the provisions of articles 1316-3 and 1316-4 of the French Civil Code.

- The order will be recorded once the CLIENT has validated the information contained on the payment page.

- The contract will be definitively concluded once payment has been accepted by the CLIENT's bank.

- Once the order has been definitively validated, a confirmation e-mail will be sent to the CLIENT, summarizing all the elements relating to the order.

Article 5 : Prices of PRODUCTS and SERVICES

All prices for SERVICES and PRODUCTS offered by the https://ecom-escape.com website are indicated in Euros, inclusive of all taxes (TTC) and correspond to those in force on the day of the order.

These prices are subject to change by the site owner at any time, without any obligation to give prior notice.

Article 6: Terms of order execution and delivery

The SERVICES and PRODUCTS offered by the https://ecom-escape.com website are delivered electronically and by telephone, to the e-mail address indicated by the CLIENT when placing the order.

Consequently, the COMPANY may not be held liable in the event of an error in the CLIENT's own contact details.

Likewise, the COMPANY and/or its representatives shall not be held liable for errors in content, viruses or any other element that may affect the integrity of the CLIENT's electronic system, nor for any technical failure of its secure online payment system.

The order will be delivered no later than forty-eight (48) hours from the date and time the CLIENT placed the order, subject to acceptance of payment by the CLIENT's bank.

In addition, it will be possible, in the event of agreement between the CLIENT and THE COMPANY, to postpone delivery of the SERVICE or PRODUCT ordered. This is particularly the case for individual coaching services, for which a date must be discussed between the CLIENT and THE COMPANY.

For PRODUCTS or SERVICES consisting of a subscription, delivery is defined as the provision to the CLIENT of the first module, session or document of the subscription concerned.

In accordance with the legal provisions in force, https://ecom-escape.com guarantees the CLIENT against any defects in conformity of the SERVICES and PRODUCTS delivered.

In the event of non-conformity or malfunction of one of these PRODUCTS or SERVICES, the CLIENT must make any claim by e-mail, no later than the second working day following the order, to the following e-mail address: contact@ecom-escape.com .

Any complaint made after this deadline and/or not made in accordance with the above-mentioned procedures will be rejected without possibility of recourse and will release the site https://ecom-escape.com from any liability towards the CLIENT.

Article 7: Legal withdrawal period

In accordance with the provisions of Articles L.221-18 et seq. of the French Consumer Code, the CLIENT has a right of withdrawal within fourteen (14) days of confirmation of the order by e-mail.

This withdrawal period will be effected by e-mail to contact@ecom-escape.com .

The e-mail concerning the use of this withdrawal period must mention the CUSTOMER's name and contact details, and expressly state "Exercise of the withdrawal period provided for in articles L.221-18 et seq. of the French Consumer Code" as the subject.

Subject to the CLIENT's compliance with these formalities, any sums paid by the CLIENT will be reimbursed within a maximum period of FOURTEEN (14) days from the date on which the CLIENT is informed of his decision to withdraw, in accordance with article L. 221-24 of the French Consumer Code.

Article 8: Exclusion specific to digital download products

The provisions of articles L 221-18 et seq. of the French Consumer Code do not apply to PRODUCTS sold as downloads; article L 221-28, 13° of the French Consumer Code excludes from the legal withdrawal period the "supply of digital content not provided on a physical medium, the performance of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal". This applies in particular to Ecom Escape's paid training course, which offers immediate video access to all the content taught.

Article 9: Exclusion specific to coaching

The provisions of articles L 221-18 et seq. do not apply to telephone coaching; article L 221-28, 3° of the French Consumer Code excludes from the legal withdrawal period "contracts for the supply of goods made to the consumer's specifications or clearly personalized".

Article 10 : Customer's personal information

The various items of information requested from the CLIENT when placing an order are necessary for processing the order and may be communicated to the company's various contractual partners (accountants, lawyers, etc.), as well as to any competent authority, in the event of any dispute arising during the course of the contractual relationship between the parties.

Computerized registers, kept on the servers of the https://ecom-escape.com site, as well as on the servers of its banking establishments, are carried out on a reliable and secure server.

In accordance with the provisions of the French Data Protection Act of January 6, 1978, the CLIENT has the right to access and rectify information concerning him/her, which he/she may exercise by sending a request to the following e-mail address: contact@ecom-escape.com .

Article 11: Intellectual property

The PRODUCTS and SERVICES offered on the https://ecom-escape.com site, and more generally all the content presented on this site, are and remain the property of the COMPANY under the provisions of the French Intellectual Property Code.

Any reproduction, transfer or exploitation of any of these PRODUCTS and/or SERVICES, in any manner whatsoever, without the prior consent of their author, is strictly forbidden and will result in all legal, criminal and/or civil proceedings against the offender, as provided for by law.

Article 12: No guarantee of results

The PRODUCTS and SERVICES offered on the https://ecom-escape.com site, and more generally all the content presented on this site, do not constitute a guarantee of results for the CLIENT.

In fact, the COMPANY cannot be held responsible for the CLIENT's economic health, for which far too many parameters external to the PRODUCTS and SERVICES offered come into play.

Article 13 : Right of reserve

The COMPANY reserves the right to refuse to honour an order from a CLIENT with whom a payment dispute is being administered.

Furthermore, the COMPANY reserves the right to refuse to carry out telephone coaching if we consider that the requests for advice are not within our area of competence. In this case, any sums paid will be refunded in full to the CLIENT.

Similarly, the COMPANY reserves the right to refuse to carry out a training sale if we consider that these do not correspond to the real needs of the CUSTOMER. In this case, the amounts paid will be reimbursed in full to the CLIENT.

Finally, the COMPANY reserves the right to refuse to carry out a SERVICE (telephone coaching or training) with the CLIENT if the latter has requested reimbursement for a previous service. If the CLIENT is not satisfied with the SERVICE, there is no reason for the COMPANY to repeat another one.

Article 14: Applicable law and language

All clauses contained in these ToS are subject to French law and written in the English language.

Consequently, they may only be interpreted in the light of the latter.
